MISSOULA – A federal judge is once more denying the motion to dismiss the lawsuit against the publisher of the “Daily Stormer” website, saying it would be “premature” to reject the case filed by a Whitefish woman.
Daily Stormer publisher Andrew Anglin was sued last year by Tanya Gersh, toward the end of several weeks of “alt-right” debate in Whitefish involving movement leader Richard Spencer.
Gersh maintains she and her family were threatened by Anglin after he had published several articles on the neo-Nazi website. Gersh maintains Anglin published her personal contact information, along with that of her friends and family while calling his readers to a “troll storm” saying they were “sickened by their Jew agenda.”
Anglin had accused Gersh of pressuring Spencer’s mother during a real estate deal.
Anglin maintains his First Amendment rights were violated.
Earlier this year, U.S. Magistrate Judge Jeremiah Lynch had rejected Anglin’s motion to dismiss the case on this grounds, and this week U.S. District Court Judge Dana Christensen is reaffirming that ruling.
At this point, the case is set to go to trial Jan. 22.
